Question by devin c: Payday advance loan fraud?
My gf just got a phone call from a attorneys office that SAID she took out a loan from “quick cash advance” 3 yrs ago she never paid back. (She never took out the loan) but she asked who to contact to straighten it out, and he said its too late, they are contacting the local pd to “pick her up” she is crying and scared now because the rep wouldn’t give her any information really. What the hell is going on? Fraud? Identity theft? Can u be arrested for this (even though she didn’t take out the loan)?

    Its a scam . A genuine attorney or bailiff will always give details of who they are etc.

    That is a scam. If the police haven’t shown up at her door by now, they won’t. “Quick Cash Advance” will have to have proof in any case, AND they would have to contact her to pay them back before it ever got to an attorney.

    Yea that’s def a scam, she wouldn’t have been warned if that was the case. The police would have shown up at her door w/ out a warning. Those type of places would have been on her case if she “supposedly” pulled out a loan in less than 3 yrs. I don’t think she should worry. But she prob wanna make sure her identity is not being stolen, that don’t sound right.

    This is not only a scam but the people who called her are breaking the law by threatening her with arrest

    If she knows the number they called from she first needs to contact her local police, non emergency number, and report that she is being blackmailed and threatened

    The police cannot arrest someone for failure to repay a loan even if she did take one out. This is a civil matter. The only thing that could happen is they send a process server to her door to deliver a summons to civil court. This is nothing to be scared of – its up to the collections agency to provide proof that your gf did take out the loan. If they don’t have the proof the case gets thrown out

    To make sure your GF was not the victim of identity theft, she needs to run her credit reports ASAP. She can run all three (Experian, Equifax, TransUnion) once a year for free on annualcreditreport.com. A friend kept getting calls about an unpaid debt and assumed it was a scam until her father told her to run a credit report and it turns out that her identity was stolen, someone had taken out a loan and had also opened and maxed out two store credit cards

    If anything does show up she needs to follow all of the steps on the FTC Website

    If nothing shows up, if they call again she needs to say the following “I am required to inform you that all calls to this number are being recorded as part of an ongoing police investigation. If you do not consent to having this call recorded then you must hang up now and all correspondence must take place through the mail”

    if they don’t hang up after that then say “I do not acknowledge this debt. Per the Fair Debt Collections Act I am requiring written proof of this debt be mailed to my home address by certified mail as required by law. In addition you are to immediately cease and desist all telephone communication and all future communication can only take place in writing”
    Once she says that they are not allowed to call her again or she can pursue harassment charges against them

    to bad both of you did not hear the “threat” or better have it recorded it is a criminal charge for a collection agent to say that and they would be fined and possible jail. Tell your g/f not to sweat it and next call record it and file criminal complaint as well as report to your states consumer credit agency

    Fair debt collection law clears all of these little scams up. There is no way in hell you can be arrested for not paying a debt and the debt collector does not threaten you. Do not fall for these little middle eastern people scam. They use the word “arrested” as a scare tactic. Obviously, they do not know the law and the words that they use are not used properly. Please contact the Federal Trade Commission and the Better Business Bureau to file a complaint.
