Bankruptcy, do they still use the last 6 months for the means test even if your situation has changed?
Ok, me and my husband are going to file for bankruptcy, most of the debt is medical bills. If my husband was collecting unemployment and then it ran out for two months and then he got a job, do they still go by the last 6 months? Even if he has a job. Just to clarify, We are below the median for our state either way we do it. Also if we are planning on moving (rent) should we do it before or after we file? The town we will rent in doesn’t do credit checks to it doesn’t really matter.

Yes, they still use the last 6 calendar months even if your situation has changed. Often those who lost a high-paying job need to wait 3, 4, 5, sometimes even 6 months to file bankruptcy before their “”annualized” monthly income averaged by the method required in the Means Test, doesn’t still classify them as high income debtors.
If your future landlord doesn’t run credit checks on future tenants, then it doesn’t really matter.
